The Council announced on Wednesday that it did not satisfy Telecentro’s request to clarify whether the new regulatory accounting model for universal services of economic importance, planned by the Communications Regulatory Authority (RRT), restricts Telecentro’s activities.

“Such an investigation would not correspond to the institution’s operational priority – to conduct investigations that significantly contribute to effective competition protection and consumer welfare,” the council announced.
Telecentro indicated to the council that under the new accounting, it does not receive a reasonable return for services provided to LRT, and the income from it does not cover its costs.
The Competition Council, in turn, explained that the request is more related to Telecentro’s economic interests – the amount of compensation received for the service, rather than competition distortion: “The applicant did not provide specific economic data or analysis that would reasonably suggest that the contested regulation could have a direct negative impact on end users’ ability to use services, their quality, choice, or price.”
Moreover, according to the institution, the dispute between Telecentro and LRT on the same issue is being resolved by the Regional Administrative Court, which will examine the case more efficiently.

The council’s decision can be appealed to the Regional Administrative Court within a month.
As BNS wrote, about two years ago the Seimas instructed the RRT to assess the reasonableness of Telecentro’s service pricing, with Telecentro and LRT disputing this in court.
Last July, the Supreme Court of Lithuania finally decided that Telecentro did not apply unfair pricing to LRT and is not obliged to return the overpayment of 327 thousand euros considered to be made to the public broadcaster.
Telecentro’s revenue from radio and television program transmission in the first half of this year amounted to 3.76 million euros.
