The prosecutor’s office spent almost four months investigating who owned the recording device found at the Lithuanian Social Democratic Party (LSDP) council meeting on April 16 and whether a crime was committed using it.

The law enforcement investigated whether the device was left intentionally and whether information was collected illegally with it, but on Tuesday finally announced that they identified only the owner – an LRT journalist, but did not see any criminal offense from the collected evidence and testimonies, so the investigation was terminated.
S. Luščikas immediately after the incident said he saw E. Samoškaitė kicking the pen under the table, and he repeated his statements when giving testimony to the police.
At the same time, the journalist herself, who previously denied having such a device, now admitted that the pen was hers, but continues to claim she did not leave it intentionally. She says she only noticed later that she lost it.
The Social Democrats are still considering whether to appeal the decision to a higher prosecutor – they have 20 days to do so.
However, S. Luščikas sticks to his version – he says that regardless of what the party’s decision will be, he knows what he saw and does not doubt that the journalist herself recorded it.

“What she initially told both journalists and LRT – that she didn’t even have such a pen. There was such a conversation. Now, having managed to get out of it, she speaks differently.
I probably won’t comment on the prosecutors’ decision. Whether we will appeal or not – I don’t know, we will discuss it in the party, maybe we don’t want to get involved further. And regarding her comment – I think the best answer is this: she and I know what happened, and she knows that I know that I saw that thing,” the Social Democrat insisted.
He explained what, to his knowledge, law enforcement found in the device and why the recording of that day’s meeting, which according to the Social Democrat was definitely made and could have led to a different prosecutors’ decision, did not survive.
The parliamentarian hinted that there were also video cameras in the hall, but that also did not help the investigation.
