“Yesterday we took over (the factory – BNS) according to the ESOC (Emergency Situations Operations Center – BNS) order to manage, receive (waste – BNS) and operate. We are accepting biodegradable (waste – BNS) today. (…) We ensure continuity of operations, which was not guaranteed,” VAATC head Marius Švaikauskas told BNS on Saturday.

“The entire court decision is based on the execution of the ESOC order to ensure continuity of operations and that VAATC employees are not hindered in ensuring continuity. Continuity is what is meant by waste management and acceptance,” he added.
M. Švaikauskas said that since Friday there has not been a single “Energesman” employee on the factory premises.
“There has not been a single ‘Energesman’ employee since last night. We politely asked everyone to leave. (…) We explained the situation to everyone, showed the court decisions, and the bailiff’s enforcement documents,” the VAATC head explained.
In turn, “Energesman” claims that the court ruling does not grant VAATC the right to take over the factory’s operation.
The Vilnius City District Court on Friday granted VAATC’s request for interim protective measures – until the final court decision is made – but no longer than until the end of this year – prohibiting “Energesman” from interfering with VAATC’s actions related to waste management on the territory of the Vilnius mechanical biological treatment (MBT) waste facilities.
“Energesman” intends to appeal this decision.
BNS wrote that VAATC filed a lawsuit on July 16 – after announcing the termination of the contract with “Energesman” and seeking to take control of the factory, the latter hindered the center’s representatives from entering the factory premises.
In turn, “Energesman” sought in court to suspend the July 10 VAATC decision to unilaterally terminate the contract with the company, but the Vilnius Regional Court this week denied “Energesman”’s request. According to the court, the contract has not yet been terminated because “Energesman” was given 20 working days to correct possible violations.
This deadline will expire on August 7.
The waste crisis in the Vilnius region arose due to last year’s fire at the Vilnius waste sorting plant, which has not yet resumed operations, and the reduction of waste incineration volumes at the Vilnius cogeneration power plant.
