„The LAT selection board decided to accept the cassation appeal of the convicted Andrius Vyšniauskas. The case will be examined in a written procedure,“ LAT representative Tautvilė Merkevičiūtė told BNS on Monday.

According to her, the appeal requests to annul the court decisions and terminate the criminal case or annul the Court of Appeal’s verdict and send the case for re-examination. It also requests to recover the incurred litigation costs.
LAT has not yet determined when it will examine the former parliamentarian’s case.
As BNS wrote, the Lithuanian Court of Appeal confirmed A. Vyšniauskas’s guilt in June for abuse of office, fraud, and document forgery, but reduced the fine and the confiscated amount imposed on him.
The court made these changes considering the mitigated liability for abuse under the Criminal Code and finding that A. Vyšniauskas’s expenses for phones, modem, and car maintenance could have been related to his activities as a council member.
The Court of Appeal reduced the fine for the former member of the Seimas from 7,500 to 6,500 euros, and the amount corresponding to the damage caused to the municipality to be confiscated from 2,100 to 1,300 euros.

The Court of Appeal also left unchanged the criminal sanction – a three-year ban on holding positions elected or appointed by state or municipal institutions and their establishments or enterprises.
According to the case data, A. Vyšniauskas, while serving as a municipal council member in 2019–2020, forged 19 expense summaries, indicating false data about fuel expenses incurred by him as a council member, and submitted them to accounting.
According to the court, by such actions he abused his official position, fraudulently acquired property belonging to the municipality worth more than 1,300 euros for his benefit, and thus caused material and significant non-material damage to the municipality.
