District Judge Indira Talwani has issued a preliminary court ruling prohibiting the U.S. Postal Service (USPS) from implementing a plan that critics say would restrict the distribution of mail-in ballots.
I. Talwani had previously issued a temporary injunction halting the USPS plan in a lawsuit filed by a coalition of Democratic-led states.
The Democratic-led states sued the administration arguing that under the U.S. Constitution, states, not the federal government, retain broad control over election administration.
The Trump administration appealed I. Talwani’s earlier ruling to the Supreme Court seeking to overturn it, and it is expected to do the same with the judge’s latest decision.
I. Talwani stated that there is not enough time to implement new procedures before the November elections and that they pose a threat of “depriving millions of U.S. citizens seeking to vote by mail of their voting rights.”
North Carolina began sending out mail-in ballots on Friday, with other states expected to follow suit in the coming days.
D. Trump signed an executive order in March aimed at restricting mail-in voting, claiming without evidence that it is vulnerable to fraud.

D. Trump’s order would require the creation of voter lists of those eligible to vote, and USPS would deliver ballots only to voters on those lists.
A USPS whistleblower warned this week that millions of Americans might not receive mail-in ballots because the postal service’s systems were developed “carelessly and hastily.”
D. Trump has long criticized mail-in voting but has frequently used it himself, including last month when he voted by mail in the Florida Republican primaries.
The president has for years claimed without evidence that mail-in voting is highly susceptible to fraud and has repeatedly linked this to his false claim that the 2020 presidential election was stolen from him by Democrat Joe Biden.
Polls show that D. Trump’s Republican Party faces a serious risk of losing control of Congress in November, especially the House of Representatives.
If the Democrats win, they have indicated they would block D. Trump’s agenda and might even take steps to impeach him for a third time.
