ES court finally rejected BKT's claim regarding sanctions on Belarusian fertilizer transit

According to the portal, the court on Wednesday dismissed the entire claim in which BKT requested the EU Council to adopt new rules or exceptions for transit. As a result, BKT was ordered to cover the litigation costs.

According to the Court, the claim was dismissed because the company was late in appealing the ban on the transit of potash fertilizers – the ban came into effect earlier, and BKT filed the claim only after several years, when the deadline had already expired. Moreover, the court does not have the power to change the decisions of the EU Council.

Last May, the EU General Court dismissed part of BKT’s claim, which challenged the restrictive measures adopted by the European Commission that led to the Lithuanian Government’s decision in February 2022 to stop the transit of “Belaruskalij” fertilizers through the Klaipėda port. However, the litigation continued regarding another part of the claim.

As BNS wrote, the transit of “Belaruskalij” from the border with Belarus to the Klaipėda port had been ongoing for more than a decade and was supposed to continue until the end of 2023, but was terminated on February 1, 2022.
