As previously reported by the portal “Delfi”, the building permit for the Pinskų family homestead was initially issued illegally, but after the State Territorial Planning and Construction Inspectorate (VTPSI) began an inspection, the land use designation and its usage method were changed, thus correcting the possible violation.
According to “Delfi”, the Širvintos district municipality issued Živilė and Jonas Pinskas a permit in 2024 to build a residential building on an agricultural land plot. None of the Pinskai had declared themselves as farmers, so they had no right to build a residential building on agricultural land.
According to Member of Parliament, conservative Mindaugas Lingė, who appealed to the General Prosecutor’s Office on this matter, the land use designation was changed from agricultural to residential area by the director of the Širvintos district municipality administration, Ingrida Baltušytė, who was appointed to the position by Ž. Pinskuvienė.
The State Territorial Planning and Construction Inspectorate (VTPSI), responding to questions raised in the public space regarding construction in Kaimynų village, Širvintos district, noted on Tuesday that the possibility to remove identified violations is not an exclusive privilege – it is part of the state supervision process provided for in legal acts.
“In 2021, a building permit (SLD) was issued for the land plot in Kaimynų village, which was valid when the current owners acquired the plot. Later, after changing the project solutions, a new project was prepared, based on which a new SLD was issued on November 6, 2024. Upon issuing the new SLD, the validity of the 2021 SLD was canceled.
VTPSI began a legality check of the SLD issued on November 6, 2024, in June 2026. During this check, it was found that the planned construction of a residential house and garage under this document did not comply with the main land use designation and usage method established for the plot at that time.
Due to the identified non-compliance, VTPSI issued mandatory instructions to the designer, the Širvintos district municipality administration, and the builders, requiring explanations as to why the land use designation and usage method were not changed for the planned construction.
In compliance with the mandatory instruction from VTPSI, the builders’ representative informed VTPSI that on July 2, 2026, the land use designation and usage method were changed,” the inspectorate’s statement reads.
VTPSI notes that the possibility to remove violations is provided for by legal acts.
“Even in cases where the inspection act states that the SLD was issued illegally, a deadline is granted to remove violations in cases specified in Article 10, Paragraph 7 of the Law on State Supervision of Territorial Planning, Construction, and Land Use. Only if violations are not removed within the set deadline are further actions provided for in legal acts regarding the cancellation of the SLD validity taken,” the statement says.
After receiving information about the changed land use designation and usage method, VTPSI evaluated the legality of the decision of the director of the Širvintos district municipality administration dated July 2, 2026, which changed the main land use designation and usage method of the plot.
“It was found that the decision does not contradict the provisions of the Territorial Planning Law and the solutions of the Širvintos district municipality general plan.
The possibility to change the agricultural designation of this plot to another and to establish the usage method for single-family and two-family residential buildings was provided for in the valid municipal general plan.
Considering the data collected during the inspection and the changed circumstances, the legality check of the SLD was completed on July 30, 2026. The conclusion of the inspection act is that the SLD was issued legally (violations removed),” the statement concludes.
Other violations identified
According to the inspectorate, the circumstances of the building project preparation were also evaluated during the inspection. VTPSI identified violations related to the project preparation in the designer’s activities and on July 31, 2026, transferred the information about them to the Lithuanian Chamber of Architects according to competence.
VTPSI claims that the goal of state supervision is not only to identify violations but also to ensure their removal when allowed by legal acts. When violations cannot be removed or are not removed within the set deadline, consequences provided for in legal acts are applied. According to the inspectorate, these principles are applied equally to everyone, regardless of the person’s position, status, or notoriety.
