The court did not satisfy A. Alekseičikas Kirinovas’s request to reinstate him, but decided that the Vilnius City Mental Health Center must pay the doctor 48 thousand euros for forced absences. In addition, the hospital must pay severance compensation – 24 thousand euros and cover court costs – 8.7 thousand euros.
The Vilnius City Mental Health Center asked the court to spread the payments over a longer period, but the court rejected the request.
As BNS wrote, the doctor litigated with the Vilnius City Mental Health Center regarding reinstatement and compensation.
The Supreme Court of Lithuania (LAT) at the end of March recognized that psychiatrist A. Alekseičikas Kirinovas was unlawfully dismissed from work, unjustly attributed with a gross violation of work duties.
The part of the case concerning the plaintiff’s reinstatement and awarded compensation was returned by LAT for reconsideration by the first instance court, as not all significant factual circumstances were established for the final decision.

The Supreme Court found that the psychiatrist’s statements given during an interview to the media, which led to the termination of the employment contract, were not related to his work activity, as they expressed a personal opinion about homosexuality in the development of medical science, not the institution’s.
The court explained that the employee’s duty of loyalty not to discredit the employer cannot be interpreted so broadly as to include the employee’s duty not to express their beliefs on matters not directly related to the performance of work functions.
Last May, the Vilnius City District Court rejected the complaint of A. Alekseičikas Kirinovas, dismissed from the Vilnius City Mental Health Center.
The doctor who worked at this institution and was head of the Borderline States Department was dismissed after public outrage arose due to his statements about homosexuality. In an interview with the publication “Šiaurės Atėnai,” he stated that homosexuality can be treated.
