HISK, „Tilsta“ and „Rizzani“ filed four claims against „LTG Infra“ regarding the „Rail Baltica“ construction contracts

As informed to “Verslo žinios” by the Vilnius District Court, the construction and real estate development company HISK is seeking in court to have the contract concluded with “LTG Infra” for the embankment construction section Berčiūnai–Joniškėlis declared invalid from the moment of its conclusion. The contract, concluded last October, is valued at 100 million euros (excluding VAT).

The construction company “Tilsta” has applied to the court regarding the contract for construction works on the Kaunas (Palemonas)–Šveicarija section, demanding that “LTG Infra” be ordered to check and approve the work project and impose a fine of 600 euros for each day. Additionally, “Tilsta” is demanding 736 thousand euros in debt and 16 thousand euros in late payment penalties from “LTG Infra” in court. According to the company, “LTG Infra” has not fully settled payments for the works performed in the Žeimiai–Šėta section.

Meanwhile, the financially troubled and restructuring Italian company “Rizzani de Eccher” is seeking in court to have “LTG Infra’s” decision to terminate the contract for the construction of the “Rail Baltica” bridge over the Neris River, valued at about 97 million euros, declared illegal and is requesting “LTG Infra” to remove “Rizzani” from the list of unreliable suppliers.

The contract termination was announced in June this year. At that time, “LTG Infra” stated that the decision was made after evaluating the contractor’s action plan on how “Rizzani,” which has not settled with subcontractors and has lost disputes in courts, could continue construction.

As BNS reported, some of “Rizzani’s” subcontractors have already won about 1.3 million euros in debts in Lithuanian courts: 0.36 million euros with 6% annual interest – the crane rental company “Sarens,” 0.45 million euros with 10.15% interest – the German capital concrete products supplier “Heidelberg Materials Lietuva Betonas,” 0.3 million euros – the state-owned group “Epso-G” energy infrastructure company “Tetas,” 0.21 million euros – the Vilnius pump and pumping systems rental company “Renta pumps.”

“LTG Infra” announced at the beginning of February that it is considering the possibility of direct settlements with Lithuanian subcontractors for future works on the bridge construction.

According to LTG, the bridge still needs columns and bridge decks to be concreted. These works can be completed in a little over a year.

BNS wrote that in April 2022, “LTG Infra” signed a contract worth nearly 77.4 million euros (including VAT) with “Rizzani de Eccher,” which committed to building the longest railway bridge in the Baltic States. Later, after indexing, the project cost increased to 96.8 million euros (including VAT).
