The Vilnius District Court on Monday dismissed Energesman’s request to apply interim protective measures. According to him, the contract has not yet been terminated because Energesman was given 20 working days to correct possible violations.
The requested interim protective measures are intended for the not yet occurred actual termination of the operation contract. Since the plaintiff (Energesman – BNS) does not raise the issue of the validity of the established 20 working days warning period for correcting deficiencies, there is no basis for the conclusion on the application of interim protective measures regarding the necessity of the decisions made on July 10, 2026, before the claim is filed,” the court ruling, which can still be appealed, states.
The VAATC announced the contract termination on July 10. According to the court, this means that the last day to correct possible contract violations is August 7, and after this deadline, VAATC will make a final decision regarding the contract.
