The vehicle attracted the attention of officers because it was swerving from one side of the road to the other.

After stopping the car, officers noticed that the driver was clearly intoxicated. D. Virkutis was detained and taken to the police station, where a sobriety test was conducted.

An alcohol concentration of 78 micrograms per 100 ml of exhaled air was detected. The usual permissible limit is 22 micrograms, but for D. Virkutis, who did not have a driver’s license, a limit of 9 micrograms applied. Thus, the detected alcohol concentration exceeded it by almost nine times.
