The Vilnius District Court on Friday rejected Energesman’s request for interim protective measures – the company asked to suspend the VAATC decision to unilaterally terminate the factory operation agreement.

According to the court, this decision was made considering the emergency situation related to the waste sorting crisis in the Vilnius region and the public interest.

“If the interim protective measures requested by the plaintiff Energesman were applied and the defendant was prohibited from taking actions related to the contract termination, the parties would be obliged to continue legal relations for an indefinite period, (…) which (…) have reached a critical level and pose a significant threat to the public, possibly violating the public interest due to the management of the waste handling crisis and the prompt resolution of arising problems, which in this case should be prioritized over the private entity’s property interest,” the court ruling states, which can still be appealed.
