As reported by the court on Tuesday, M. Š., who was found guilty of illegal activities of a legal entity and fraud involving 88,375 euros from more than 250 individuals and legal entities, was sentenced to a final three-year prison term, with the execution suspended for two years.

According to the case concluded on July 31, M. Š. established a company that practically conducted no economic commercial activity; it was used to conceal illegal activities.
Using the company’s name, the impression of a legally operating trading entity was created, and alleged sales of used cars and new mobile phones were conducted through an online store.
Advertisements on portals claimed to sell cars such as the “BMW 328 Xi,” “Audi A6,” and “Audi Q3.” Misled buyers transferred advance payments for the sale and delivery of cars to the company’s account, but the cars were never delivered to them.
At the same time, mobile phones were offered at lower than market prices in the online store “www.telemaxi.lt.” Buyers who placed orders transferred money to the company’s accounts but did not receive the ordered goods.
The court found that the fraud was continuous and well-organized, affecting many individuals and legal entities, and the damage caused has essentially not been compensated to this day.
The court also assessed that M. Š. was not the organizer of the criminal scheme, acted under the direction of others, personally withdrew less than half of the total fraudulently obtained amount, and there was no reliable evidence in the case that he received the full promised reward.
The court recognized as a mitigating circumstance that M. Š. admitted the essential circumstances of the criminal acts, sincerely regretted, and acknowledged the legitimacy of the victims’ property claims. An aggravating circumstance was that he committed the criminal acts as part of a group of accomplices.
When imposing the sentence, the court took into account that M. Š. was 19 years old at the time of the criminal acts, nearly eight years have passed since the acts, during which he has not committed new crimes, works, has not evaded the court, and did not delay the process.
During the entire period of suspension of the sentence execution, M. Š. is required to continue working or studying, stay at his place of residence from 11 p.m. to 6 a.m. unless leaving is related to work or study, and not leave the city or district of residence without permission from the institution supervising the convict.
He must also participate in a behavior correction program within nine months from the date the verdict becomes final.
The court also imposed a criminal sanction on M. Š. – a two-year ban on engaging in the establishment and management of legal entities and organizing electronic commerce.
The court fully satisfied the civil claims filed by the victims and civil plaintiffs.
The verdict may be appealed to the Kaunas Regional Court within 20 days from the date of its announcement.
